Acceptable Use Policy

Last Revised: 2026-09-23

Document: Acceptable Use & Abuse Policy
Domain: alivehoster.com & subdomain
Operator: ALIVES Co. (d/b/a Alive Hoster)

This Acceptable Use & Abuse Policy (“AUP”) governs the acceptable, authorized, and lawful use of all virtual, physical, cloud, network, and hosting infrastructure operated by ALIVES Co. (d/b/a Alive Hoster). This Policy forms an irrevocable, legally binding addendum to the Alive Hoster Master Terms of Service. By establishing an account, deploying any virtual compute container, leasing an IP address, or transmitting data through our network, you explicitly warrant that your workloads strictly comply with the quantitative limits and behavioral mandates established herein.

1. PURPOSE, SCOPE & CONTRACTUAL INCORPORATION

Alive Hoster is dedicated to delivering high-performance, resilient, and enterprise-grade hosting infrastructure across its globally distributed data centers. Because our computing environments rely on high-density virtualization, shared network switches, and shared IP address routing pools, abusive behavior by a single tenant directly threatens the stability, IP reputation, and operational integrity of other legitimate subscribers.

This AUP applies universally to:

  • All direct account holders, registered users, and technical contacts across the Alive Hoster Client Portal (portal.alivehoster.com);
  • All provisioned environments, including Shared Web Hosting, WordPress Hosting, Reseller cPanel/DirectAdmin/Webuzo/Plesk accounts, KVM Virtual Private Servers (VPS), Cloud Compute VPS, ARM64 VPS/VDS, Dedicated Virtual Servers (VDS), Bare-Metal Dedicated Servers, Cloud Object Storage nodes, and Managed Business Email suites;
  • All third-party end-users, sub-clients, website visitors, and downstream subscribers hosted under our Reseller hosting platforms. Resellers are directly and strictly liable for the network behavior and hosted content of their downstream sub-accounts.

2. ZERO-TOLERANCE PROHIBITIONS (IMMEDIATE TERMINATION & LAW ENFORCEMENT ESCALATION)

Alive Hoster enforces a strict, uncompromising Zero-Tolerance threshold for egregious violations that threaten human safety, violate federal criminal statutes, or inflict severe harm on global network infrastructure. Upon detecting or receiving verified telemetry regarding any activity outlined in this Section, Alive Hoster shall immediately sever network connectivity, terminate the offending container or server without prior notice, permanently wipe all associated data, forfeit all pre-funded balances and credits without refund, and report the event with complete audit telemetry to federal and international law enforcement agencies.

Mandatory Federal Escalation: Alive Hoster cooperates fully with the Federal Bureau of Investigation (FBI), US Department of Homeland Security (DHS), National Center for Missing & Exploited Children (NCMEC), and international policing authorities (INTERPOL / Europol).
  • Child Sexual Abuse Material (CSAM) & Minor Exploitation: The storage, transmission, caching, publishing, hosting, or linking to Child Sexual Abuse Material (CSAM), non-consensual imagery of minors, child grooming forums, or child endangerment services. Pursuant to 18 U.S.C. § 2258A, all instances are immediately escalated to NCMEC and the Cyber Crimes Center;
  • Violent Extremism, Terrorism & Hate Crimes: Operating endpoints or publishing propaganda that recruits, incites, coordinates, or finances terrorist organizations, mass casualty violent acts, or violent hate crimes against protected demographics;
  • Malware Distribution, Command & Control (C2) & Ransomware: Hosting, distributing, compiling, or executing Command & Control (C2) nodes, ransomware binaries, trojans, keyloggers, rootkits, polymorphic loaders, or weaponized zero-day exploit payloads;
  • Active Network Attacks (DDoS, Flooding & Spoofing): Initiating, relaying, facilitating, or participating in Distributed Denial of Service (DDoS) attacks, UDP reflection/amplification, SYN floods, ICMP attacks, BGP hijack routing, DNS poisoning, or packet spoofing targeting any external or internal destination;
  • Brute-Force, Penetration & Credential Stuffing: Executing automated unauthorized port scanning, vulnerability probing, credential stuffing engines, SSH/FTP brute-force dictionary attacks, or password harvesting exploits against third-party systems without documented prior mutual consent;
  • Phishing, Brand Impersonation & Financial Fraud: Deploying deceptive web properties designed to harvest credentials, banking logins, credit card numbers, multi-factor authentication (MFA) tokens, or impersonating domestic/international financial institutions, government entities, or commercial brands;
  • Darknet Marketplaces & Illicit Trafficking: Facilitating automated platforms or escrow systems for the sale, distribution, or procurement of scheduled narcotics, human trafficking, unlicensed weapons, counterfeit currency, stolen identity credentials, or stolen financial records.

3. QUANTITATIVE RESOURCE USAGE & TECHNICAL THRESHOLDS (FAIR USE POLICY)

To preserve multi-tenant stability, hypervisor responsiveness, and network equilibrium, customer workloads must adhere strictly to the quantitative fair-use metrics detailed below. Exceeding these limits degrades adjacent containers and constitutes resource abuse.

Environment / ParameterQuantitative Threshold / RuleEnforcement & Throttling Action
Continuous CPU Utilization (Shared Web Hosting)Processes must not consume greater than 50% of an assigned CPU core for longer than sixty (60) contiguous seconds.Automated kernel-level CloudLinux / cgroups CPU throttling or process termination (SIGKILL).
Automated Cron Job Execution FrequencyScheduled tasks (cron jobs) must not execute at intervals more frequent than once every fifteen (15) minutes. Rapid 1-minute looping cron scripts are prohibited.Automated crontab disabling or process descheduling by platform security monitors.
Inode / File Allocation LimitsShared hosting accounts are subject to soft caps of 250,000 inodes and hard caps of 350,000 inodes per cPanel/DirectAdmin/Webuzo container.Filesystem write lock. Further file creation or database expansion is paused until disk cleanup.
Simultaneous Database ConnectionsMaximum 30 to 50 concurrent active MySQL/MariaDB connections per individual database user on shared platforms.Excess connection requests rejected with HTTP 503 / Database Overload status codes.
User Backup Archiving RetentionUser-generated cPanel/DirectAdmin full backup archives (.tar.gz) stored directly in home directories must be downloaded locally within seven (7) calendar days.Automated file purge routines permanently expunge stale backup archives after day 7 to recover multi-tenant disk arrays.
VPS / VDS Hypervisor Disk I/O SaturationContinuous random/sequential read/write operations causing prolonged hypervisor I/O Wait (iowait > 25%) exceeding 15 minutes is prohibited.Hypervisor I/O rate limiting (IOPS throttling) applied to the virtual disk volume.
Unmanaged VPS Bandwidth OverageExceeding the pre-allocated monthly high-speed egress bandwidth allotment assigned to the VPS instance.Port dynamically throttled down to 10 Mbps fair-use rate until the start of the next calendar billing cycle.

3.1 Absolute Prohibition on Cryptocurrency Mining

The execution of any proof-of-work (PoW), proof-of-space, or cryptographic hashing algorithm (including, but not limited to, Bitcoin, Monero, Ravencoin, Chia plotting, or browser-based mining scripts like Coinhive) is strictly prohibited across all Shared Hosting, Cloud VPS, KVM VPS, ARM64 VPS, and Dedicated VDS instances. Any virtual compute instance detected running crypto-mining binaries will be instantly paused, suspended, or terminated with zero liability to Alive Hoster.

3.2 Prohibited Background Daemons on Shared Hosting

Shared hosting platforms are exclusively engineered for standard web application serving. Clients may not run standalone background processes, persistent daemons, IRC bots, Shoutcast/Icecast audio servers, proxy nodes, VPN gateways, BitTorrent clients, file synchronization nodes, or web crawlers on shared web hosting servers. Such utilities require deployment on isolated KVM VPS or Dedicated infrastructure.

4. EMAIL INTEGRITY, ANTI-SPAM (CAN-SPAM) & MASS MAILING RULES

Alive Hoster maintains zero tolerance for unsolicited commercial email (UCE), spam, and malicious mail transmission. Our network strictly complies with the United States CAN-SPAM Act of 2003 (15 U.S.C. § 7701 et seq.) and global anti-abuse mailing directives.

4.1 Quantitative Outbound Email Rate Limits

Shared Hosting & Managed Business Email Cap: To safeguard IP reputation across Spamhaus, Proofpoint, and Microsoft SNDS, all shared cPanel, DirectAdmin, Webuzo, Plesk, and Business Email accounts are restricted to an outbound ceiling of one hundred (100) to one hundred fifty (150) emails per domain per hour.

4.2 Explicitly Prohibited Mailing Practices

  • Unsolicited Bulk Email (Spam): Transmitting emails to recipients who have not provided documented, affirmative, verifiable opt-in consent;
  • Purchased, Scraped, or Third-Party Contact Lists: The utilization of purchased, rented, harvested, scraped, or appended mailing lists is strictly prohibited across all shared and virtual server infrastructure;
  • List Laundering & Spamvertising: Operating websites, landing pages, or redirectors hosted on Alive Hoster infrastructure that are referenced or promoted inside spam emails dispatched from third-party networks (“spamvertising”);
  • Header Forgery & Identity Concealment: Forging, altering, or obfuscating email transmission headers, return path addresses, originating IP headers, or envelope-from identities to conceal the true source of communication;
  • Missing Unsubscribe & Postal Disclosures: Commercial marketing emails must contain a functional, one-click electronic unsubscribe mechanism and a valid physical postal address representing the sending business.

5. NETWORK & IP ADDRESS LEASE INTEGRITY

All IPv4 and IPv6 addresses routed to customer containers and servers are leased network properties belonging to Alive Hoster and our upstream transit providers. Clients receive a non-exclusive, revocable license to utilize assigned addresses strictly during active, non-defaulted service tenure.

5.1 IP Blacklisting & Remediation Fees

If an IP address leased to a Client becomes blacklisted on primary reputation clearinghouses (such as Spamhaus SBL/XBL/PBL, Barracuda BRBL, SORBS, SpamCop, or abuse.ch) as a direct result of the Client’s outbound spam, compromised scripts, or negligent security, Alive Hoster will issue an administrative security warning.

Administrative Delisting Surcharge: Alive Hoster reserves the right to assess an administrative remediation surcharge of twenty-five to fifty US dollars ($25.00–$50.00 USD) per blacklisted IP to offset technical overhead, manual delisting submissions, and upstream transit compliance disputes. Continued negligence resulting in permanent IP subnet dirtying will result in immediate lease revocation.

5.2 Open Proxies, Open Relays & Unprotected Endpoints

Operating open DNS resolvers, unauthenticated open mail relays, open TOR exit nodes, or unsecured HTTP/SOCKS proxy servers that permit arbitrary third parties to anonymously route traffic across our network is strictly prohibited. Servers discovered operating open relays will be instantly isolated until administrative remediation is verified.

6. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) & INTELLECTUAL PROPERTY COMPLIANCE

Alive Hoster respects the intellectual property rights of creators and operates in full compliance with Title II of the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512). We maintain statutory safe-harbor protections by promptly responding to valid, substantiated notifications of claimed copyright infringement.

6.1 Requirements for Submitting a Valid DMCA Takedown Notice

To file a legally sufficient DMCA Notice with our Designated Copyright Agent, the copyright owner or their authorized agent must submit a formal, written communication containing the following mandatory elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list of such works);
  3. Identification of the material claimed to be infringing or to be the subject of infringing activity, including the exact URLs, server IPs, or directory paths sufficient to enable Alive Hoster to locate the material;
  4. Information reasonably sufficient to permit Alive Hoster to contact the complaining party (including legal name, physical mailing address, telephone number, and active email address);
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

Valid notices must be dispatched directly to our Designated DMCA Agent at: support@alivehoster.com.

6.2 Customer DMCA Counter-Notification Procedure

If you believe that your hosted material was removed, disabled, or locked as a result of a mistake, misidentification, or bad-faith DMCA notice, you may submit a formal Counter-Notification pursuant to 17 U.S.C. § 512(g)(3). The Counter-Notification must be sent to support@alivehoster.com and must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before removal;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your legal name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Madison County / Eastern District of Kentucky if located outside the United States), and that you will accept service of process from the person who provided the original infringement notification.

Upon receipt of a substantiated Counter-Notification, Alive Hoster will transmit a copy to the original claimant. Unless the claimant initiates a formal federal court action seeking a restraining order against the content within ten to fourteen (10–14) business days, Alive Hoster will restore access to the disputed material pursuant to federal safe-harbor guidelines.

6.3 Repeat Infringer Policy (17 U.S.C. § 512(i))

Pursuant to statutory requirements, Alive Hoster enforces a strict Repeat Infringer policy. Accounts that are the subject of repeated, substantiated copyright infringement notifications (three or more separate verified incidents within a rolling twelve-month period) will be subject to immediate, permanent service termination without eligibility for refund or credit restoration.

7. ABUSE INVESTIGATION, NOTICE WINDOWS & REMEDIATION TIMELINES

Alive Hoster categorizes received network abuse complaints and security telemetry into three operational severity tiers, each governed by specific enforcement mechanisms and response timeframes:

Severity TierViolation ClassificationCustomer Response WindowEnforcement & Escalation
Tier 1: Critical (Zero Tolerance)CSAM, terror recruitment, active C2 botnets, outbound DDoS attacks, active phishing pages, ransomware delivery endpoints.Immediate Action (0 Hours)Instantaneous hypervisor network isolation (port null-routing) or container termination. Data preserved solely for law enforcement audit; zero refund; federal agency referral.
Tier 2: Major (High Risk)Outbound spam clusters, compromised WordPress malware redirects, brute-force dictionary attacks, open relays, severe hypervisor I/O saturation.Twelve (12) HoursService temporarily suspended or isolated into a quarantined network VLAN. An urgent support ticket is opened. If the customer fails to remediate or respond within 12 hours, the container remains suspended pending cancellation.
Tier 3: Standard (Administrative)DMCA copyright takedown notices, trademark complaints, isolated trademark disputes, minor resource overages.Twenty-Four (24) HoursNotification dispatched to Client Portal ticket desk.
