Operator: ALIVES Co. (d/b/a Alive Hoster)
These Guidelines provide comprehensive instructions for law enforcement authorities, judicial officials, regulatory bodies, and government agencies seeking information, technical records, or assistance from ALIVES Co. (d/b/a Alive Hoster). Alive Hoster operates in strict compliance with United States statutory law, the US Stored Communications Act (SCA), and applicable constitutional safeguards while preserving the legitimate procedural rights and privacy of our customers.
1. GENERAL PRINCIPLES & JURISDICTIONAL MANDATE
Alive Hoster is a commercial infrastructure and web hosting service operated by ALIVES Co., a corporation organized and existing under the laws of the Commonwealth of Kentucky, United States of America. Consequently, all formal legal demands for subscriber records, electronic communications, or technical logs are strictly subject to United States federal and Kentucky state jurisdiction.
Our core operating standards require:
- Valid Legal Process: We disclose non-public customer records or transactional data strictly in response to valid, legally binding process (e.g., judicial subpoenas, court orders under 18 U.S.C. § 2703(d), or federal search warrants);
- Non-Extensible Verification: Informal email inquiries, verbal requests, or unauthenticated correspondences are legally insufficient and will not receive substantive data disclosures;
- Data Minimization Compliance: Responsive productions are strictly tailored to the precise scope, parameters, and timeframes articulated within the authorizing legal instrument.
2. INFRASTRUCTURE ARCHITECTURE & DATA LIMITATIONS (NO-KYC POLICY DISCLOSURE)
To assist law enforcement investigators in drafting precise and realistic legal requests, Alive Hoster provides the following transparent architectural disclosure regarding our data collection and retention practices:
No-KYC Operating Reality: Alive Hoster does not perform government ID verification, Know-Your-Customer (KYC) identity indexing, biometric facial recognition, or physical address verification at account registration. Accounts are established using basic email registration.
Consequently, the categories of information Alive Hoster can produce are bounded strictly by technical realities:
| Data Category | Data Field Description | Availability & Retention Reality |
| Basic Subscriber Information (BSI) | Client Portal account profile details: Registered Name, Email Address, self-reported billing country, Account Creation UTC timestamp. | Available as self-reported by the user. Alive Hoster does not warrant or independently verify user-entered names or addresses. |
| Connection & Access Logs | Client Portal login UTC timestamps and remote source IP addresses recorded during portal access sessions. | Retained in active logs for approximately thirty (30) to ninety (90) days, after which they are automatically rotated and purged. |
| Financial Transaction Records | Payment method identifier (e.g., card processor transaction ID, EPS gateway reference, or public blockchain transaction hash [TxID]), payment timestamp, and invoiced amount. | Available. Note: Alive Hoster does not store complete credit card PANs or CVVs. For cryptocurrency settlements, only the public ledger transaction ID and recipient deposit address are recorded. |
| IP Routing & Provisioning History | Historical records of IPv4 / IPv6 addresses assigned to specific virtual containers or dedicated servers during active service tenure. | Available through internal billing and provisioning orchestration archives. |
| Customer-Hosted Stored Content | Website files, database tables, email mailboxes, and root filesystem data residing within customer containers or dedicated servers. | Only available if the service is currently active and non-cancelled. Pursuant to our lifecycle policy, cancelled or non-renewed services undergo immediate hypervisor volume destruction (wipeout), rendering forensic data recovery technologically impossible. |
3. STATUTORY STANDARDS FOR INFORMATION DISCLOSURE
Pursuant to Title II of the Electronic Communications Privacy Act (the Stored Communications Act, 18 U.S.C. §§ 2701–2712), Alive Hoster requires the following legal instruments based on the classification of data requested:
3.1 Subpoena (Federal, State, or Administrative)
A valid, formally issued grand jury subpoena, trial subpoena, or administrative subpoena issued by a court or agency of competent jurisdiction under 18 U.S.C. § 2703(c)(2) compels the production of Basic Subscriber Information (BSI) only, including:
- Account registered name and email address;
- Account creation timestamp and account status;
- Historical Client Portal login IP addresses (subject to retention limits);
- Billing ledger invoices, transaction identifiers, and means/sources of payment.
3.2 Court Order Issued Under 18 U.S.C. § 2703(d)
To compel the disclosure of non-content transactional records, server audit metadata, or expanded routing histories that exceed Basic Subscriber Information, a judicial court order issued by a judge of competent jurisdiction under 18 U.S.C. § 2703(d) is required. The order must demonstrate specific and articulable facts showing reasonable grounds to believe that the records are relevant and material to an ongoing criminal investigation.
3.3 Search Warrant (Rule 41 or State Equivalent)
Mandatory Warrant for Stored Communications Content: Under 18 U.S.C. § 2703(a) and the Fourth Amendment to the United States Constitution, Alive Hoster will never disclose the stored content of electronic communications (including hosted website files, MySQL databases, private email messages, or virtual server disk images) without a valid Search Warrant issued upon a finding of probable cause by a federal magistrate or state judge.
4. INTERNATIONAL LAW ENFORCEMENT & CROSS-BORDER REQUESTS
As a United States corporation, Alive Hoster is prohibited under federal privacy jurisprudence from disclosing subscriber records directly to non-US policing agencies in the absence of valid United States legal process.
4.1 Mutual Legal Assistance Treaties (MLAT) & Letters Rogatory
Foreign law enforcement agencies seeking information or stored records regarding an Alive Hoster subscriber must channel their requests through the formal Mutual Legal Assistance Treaty (MLAT) framework or via diplomatic Letters Rogatory coordinated with the Office of International Affairs (OIA) within the United States Department of Justice (DOJ):
Office of International Affairs (OIA)
Criminal Division, U.S. Department of Justice
1301 New York Avenue, N.W., Washington, D.C. 20530, USA
Once approved, a US federal court will issue the appropriate domestic subpoena, 2703(d) order, or search warrant compelling production.
4.2 US CLOUD Act Qualifying Agreements
Where a foreign government has entered into an effective, verified bilateral executive agreement with the United States pursuant to the Clarifying Lawful Overseas Use of Data (CLOUD) Act (18 U.S.C. § 2523), Alive Hoster will review properly certified foreign direct legal orders strictly in conformance with statutory CLOUD Act certification requirements.
5. EMERGENCY DISCLOSURE REQUESTS (IMMINENT RISK OF DEATH OR SERIOUS BODILY HARM)
Pursuant to 18 U.S.C. § 2702(b)(8) and § 2702(c)(4), Alive Hoster may voluntarily disclose records (including content and non-content) to a federal, state, or foreign law enforcement authority if Alive Hoster has a good faith belief that an emergency involving imminent danger of death or serious physical injury to any person requires disclosure without delay of information relating to the emergency.
5.1 Requirements for Emergency Requests
Law enforcement officers submitting an Emergency Disclosure Request must dispatch an official, signed communication on agency letterhead from an official government email domain (e.g., .gov, .police.uk, .fbi.gov) to support@alivehoster.com with the subject line “EMERGENCY DISCLOSURE REQUEST: IMMINENT HARM” and must include:
- Clear, specific narrative explaining the nature of the imminent emergency (e.g., hostage situation, active kidnapping, imminent suicide threat, imminent violent terror attack);
- The identity of the individual(s) whose life or physical safety is in imminent jeopardy;
- The specific Alive Hoster technical identifier (IP address, domain name, or account ID) tied to the threat;
- The precise, minimal records requested that are directly necessary to avert the emergency;
- The requesting officer’s full legal name, badge/serial number, department, telephone callback number, and supervisor verification contact.
Alive Hoster evaluates all emergency requests individually. Once the emergency is resolved, requesting agencies must follow up with formal legal process as required by statute.
6. DATA PRESERVATION REQUESTS (18 U.S.C. § 2703(f))
Pursuant to 18 U.S.C. § 2703(f), official law enforcement agencies may submit a formal Data Preservation Request directing Alive Hoster to preserve existing stored records, connection logs, and account metadata pending the issuance of a formal search warrant or court order.
- Preservation Duration: Upon receipt of a valid 2703(f) request, Alive Hoster will preserve existing relevant records for a statutory period of ninety (90) calendar days;
- One-Time Extension: The requesting agency may submit a formal renewal request extending preservation for an additional ninety (90) days;
- Point-in-Time Snapshot: Preservation requests capture existing data at the moment of request processing. 2703(f) does not authorize continuous, real-time prospective monitoring or wiretapping;
- Cancelled/Purged Services: Alive Hoster can preserve only data that actively resides on our physical systems at the time the request is received. If a service was cancelled and destroyed prior to receipt, data cannot be preserved or retrieved.
7. CUSTOMER NOTICE POLICY & GAG ORDERS
Alive Hoster believes in operational transparency. Our standard policy is to provide written notice to affected account holders when a civil or criminal legal demand seeking their records or content is served upon us, allowing the customer an opportunity to seek protective judicial relief.
Exceptions to Customer Notice: Alive Hoster will refrain from notifying the account holder if, and only if, one of the following conditions is satisfied:
- Alive Hoster is served with a valid, court-issued non-disclosure order (Gag Order) issued pursuant to 18 U.S.C. § 2705(b) explicitly forbidding customer notification for a specified statutory period;
- Notice is prohibited by applicable criminal statute or judicial protective order;
- Alive Hoster determines in its sole discretion that providing notice creates an imminent risk of death, serious physical injury, or catastrophic destruction of physical evidence.
8. STATUTORY REIMBURSEMENT FOR LEGAL COMPLIANCE COSTS
Pursuant to 18 U.S.C. § 2706, Alive Hoster is legally entitled to reimbursement for reasonable, actual costs incurred in searching for, retrieving, reviewing, duplicating, and producing requested records and technical data in response to subpoenas, warrants, or court orders. Cost schedules adhere to customary commercial and government cost-recovery models:
| Service / Production Category | Standard Statutory Cost Rate |
| Basic Account Record Search & BSI Certification | $75.00 USD (flat administrative fee) |
| Specialized Engineering / Forensic Log Extraction | $150.00 USD per engineering hour (billed in 30-minute increments) |
| Large-Scale Data Duplication & Storage Media (Encrypted) | Actual hardware media cost + $50.00 USD handling fee |
| Expedited / Rush Emergency Processing (Non-Exigent) | $200.00 USD surcharge |
Note: Alive Hoster does not assess compliance fees for mandatory CSAM child exploitation reporting to NCMEC or substantiated exigent life-safety emergencies.
